On 11 August, Law 27553 on electronic or digital prescriptions was published in the Official Gazette
The Senate and the Chamber of Deputies gathered in Congress passed the law for the use of electronic or digital records in face-to-face session on July 23. This Law consists of 16 articles. The first article states that the prescription and dispensing of medicines may be written and signed through handwritten signatures, electronic or digital, in electronic or digital prescriptions throughout the country.
In addition, this same article stipulates that telecare platforms can be used in health, throughout the Argentine territory, provided that the law of protection of personal data and the law of patient rights are complied with.
The law provides for prescriptions that are medical, dental, or other health professionals legally qualified to prescribe. In addition, the law states that medicines prescribed by electronic or digital prescriptions must be dispensed at any pharmacy in Argentina, pharmacies of health centers, and other health facilities. This also applies to all telecare platforms used in the country.
However, for the implementation of the law it is suggested that existing electronic systems be developed and/or adapted. The Executive Branch should establish bodies governing health telecare platforms for the application of remote consultations or digital or electronic prescriptions.
For medicines, pharmacies must comply with a digital record of the following: Prescription, Narcotics Comptroller, Psychotropic Comptroller, Inspections, and other relevant digital records or files.
The application of these regulations benefits the exercise of telehealth in Argentina, promoting the use of telecare platforms and electronic recipes. Finally, the law invites the provinces and the Autonomous City of Buenos Aires to adhere to the new Law on Digital or Electronic Prescriptions.
