On 11 August, Law 27553 on electronic or digital prescriptions was published in the Official Gazette<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

The Senate and the Chamber of Deputies gathered in Congress passed the law for the use of electronic or digital records in face-to-face session on July 23. This Law consists of 16 articles. The first article states that the prescription and dispensing of medicines may be written and signed through handwritten signatures, electronic or digital, in electronic or digital prescriptions throughout the country.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

In addition, this same article stipulates that telecare platforms can be used in health, throughout the Argentine territory, provided that the law of protection of personal data and the law of patient rights are complied with.<\/p>

The law provides for prescriptions that are medical, dental, or other health professionals legally qualified to prescribe. In addition, the law states that medicines prescribed by electronic or digital prescriptions must be dispensed at any pharmacy in Argentina, pharmacies of health centers, and other health facilities. This also applies to all telecare platforms used in the country.<\/p>

However, for the implementation of the law it is suggested that existing electronic systems be developed and\/or adapted. The Executive Branch should establish bodies governing health telecare platforms for the application of remote consultations or digital or electronic prescriptions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t

For medicines, pharmacies must comply with a digital record of the following: Prescription, Narcotics Comptroller, Psychotropic Comptroller, Inspections, and other relevant digital records or files.<\/p>

The application of these regulations benefits the exercise of telehealth in Argentina, promoting the use of telecare platforms and electronic recipes. Finally, the law invites the provinces and the Autonomous City of Buenos Aires to adhere to the new Law on Digital or Electronic Prescriptions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

El 11 de agosto fue publicada en el Bolet\u00edn Oficial la Ley 27553, sobre las recetas electr\u00f3nicas o digitales El senado y la c\u00e1mara de diputados reunidos en el Congreso aprobaron la ley para el uso de los registros electr\u00f3nicos o digitales en sesi\u00f3n presencial el d\u00eda 23 de julio. Esta Ley consta de 16 art\u00edculos. El primer art\u00edculo establece que la prescripci\u00f3n y dispensaci\u00f3n de medicamentos pueden ser redactadas y firmadas a trav\u00e9s de firmas manuscritas, electr\u00f3nicas o digitales, en recetas electr\u00f3nicas o digitales en todo el pa\u00eds. Adem\u00e1s, en este mismo art\u00edculo se establece que se puedan utilizar plataformas de teleasistencia en salud, en todo el territorio argentino, siempre y cuando se cumpla la ley de protecci\u00f3n de datos personales y la ley de derechos del paciente. La ley contempla prescripciones m\u00e9dicas, odontol\u00f3gicas, o de otros profesionales sanitarios legalmente facultados para prescribir. Adem\u00e1s, la ley establece que los medicamentos prescriptos mediante recetas electr\u00f3nicas o digitales deben ser dispensadas en cualquier farmacia de Argentina, farmacias de centros de salud, y otros establecimientos de salud. Esto aplica adem\u00e1s para todas las plataformas de teleasistencia que se utilicen en el pa\u00eds. Sin embargo, para la implementaci\u00f3n de la ley se sugiere que se desarrollen y\/o adecuen los sistemas electr\u00f3nicos existentes. El Poder Ejecutivo debe establecer los organismos que regulen las plataformas de teleasistencia en salud para la aplicaci\u00f3n de consultas remotas o de recetas electr\u00f3nicas digitales o electr\u00f3nicas. En el caso de los medicamentos, las farmacias deben cumplir un registro en archivos digitales de lo siguiente: Recetario, Contralor de estupefacientes, Contralor de psicotr\u00f3picos, Inspecciones y otros registros o archivos digitales pertinentes. La aplicaci\u00f3n de estas regulaciones beneficia el ejercicio de la telesalud en Argentina, promoviendo el uso de plataformas de teleasistencia y las recetas electr\u00f3nicas.  Finalmente, la ley invita a las provincias y a la Ciudad Aut\u00f3noma de Buenos Aires a adherirse a la nueva Ley de recetas Digitales o Electr\u00f3nicas.
