Article 9 of Law No. 003-2019-SA approves the regulations of Law No. 30421 Telehealth Framework Law, which optimizes processes linked to Telehealth, in order to establish regulations that allow its implementation and development throughout the country.<\/p>

Through the emergency decree, the National Digital Transformation System was created and at the same time the Digital Government Act was passed which promote and regulate the use of digital technologies in processes and services provided by the State for the population.<\/p>

Following the COVID-19 crisis in Peru, its telemedicine and telehealth services were of importance in providing care to patients with different conditions and to reduce risks of contagion. Peru therefore seeks to promote this type of services with solidity and strength by creating new units and health bodies.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t

The legislative decree has 12 articles among which Article 3 stands out, which defines the main terms of Digital Health in the context of Peru:<\/p>

\u00a0<\/p>

  1. Telehealth<\/strong>: Remote health service provided by health personnel, through Information and Communication Technologies (ICT), to make these services accessible and timely to the population. This service is carried by the following development axes of Telehealth: the provision of health services, the management of health services; information, education and communication with cultural and linguistic relevance; and capacity building for health personnel, among others.<\/li>
  2. Telemedicine<\/strong>: Provision of remote health services in the components of promotion, prevention, diagnosis, treatment, recovery, rehabilitation and palliative care, provided by health staff using ICT, in order to facilitate access to health services to the population.<\/li>
  3. Teleconsulting<\/strong>: It is the remote consultation, performed by a health professional for patient care, whether or not they may be present; for the purposes of promotion, prevention, diagnosis, treatment, recovery, rehabilitation and palliative care as the case may be, complying with the regulated restrictions on the prescription of medicines and other provisions determined by the Ministry of Health.<\/li>
  4. Remote interconsulting<\/strong>: It is the remote consultation through ICTs, performed by a health professional for patient care, whether or not they may be present; for the purposes of promotion, prevention, diagnosis, treatment, recovery, rehabilitation and palliative care as the case may be, complying with the regulated restrictions on the prescription of medicines and other provisions determined by the Ministry of Health.<\/li>
  5. Remote orientation<\/strong>: It is the set of actions developed by a health professional through the use of ICT, to provide the user with health, counseling and advice for purposes of health promotion, prevention, recovery or rehabilitation of diseases.<\/li>
  6. Telemonitoring<\/strong>: It is the remote monitoring or monitoring of the user, in the Health Service Provider Institutions, in which the clinical information of the user is transmitted, and if the case warrants it according to medical considerations the biomedical parameters and\/or auxiliary examinations, as a means of control of their health situation. The prescription of medicines may or may not be included according to medical criteria and according to the competencies of other health professionals.<\/li>
  7. Interoperability<\/strong>: It is the ability of the systems of several organizations to interact with consensual and common objectives in order to obtain mutual benefits. The interaction involves health facilities sharing information and knowledge by exchanging data between their respective information and communications technology systems to finally optimize the use of resources in health services.<\/li><\/ol>

    In addition, the decree includes additional provisions, among which are the free access to these health services, which urges telephony and internet operators to provide the population with access to the communication channels available to the Ministry of Health, in addition, the use of the government's digital channel oriented to Telehealth is promoted: www.gob.pe\/telesalud<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

    Por decreto legislativo Per\u00fa fortalecer\u00e1 los alcances de la Telesalud a nivel nacional. El art\u00edculo 9 de la Ley No 003-2019-SA aprueba el reglamento de la Ley No 30421 Ley Marco de Telesalud, que optimiza procesos vinculados a Telesalud, con el objetivo de establecer las regulaciones que permitan su implementaci\u00f3n y desarrollo en todo el pa\u00eds. A trav\u00e9s del decreto de urgencia se cre\u00f3 el Sistema Nacional de Transformaci\u00f3n Digital y a la vez se aprob\u00f3 la Ley de Gobierno Digital las cuales promueven y regulan el uso de las tecnolog\u00edas digitales en procesos y servicios prestados por el Estado para la poblaci\u00f3n. Y es que tras la crisis por COVID-19 en Per\u00fa sus servicios de Telemedicina y Telesalud resultaron de suma importancia para brindar atenci\u00f3n a pacientes con diferentes padecimientos y para reducir riesgos de contagio. Por lo tanto, Per\u00fa busca impulsar este tipo de servicios con solidez y fuerza mediante la creaci\u00f3n de nuevas dependencias y \u00f3rganos de salud.  El decreto legislativo cuenta con 12 art\u00edculos entre los cuales destaca el Art\u00edculo 3, en el cual se definen los t\u00e9rminos principales de la Salud Digital en el contexto de Per\u00fa: Telesalud: Servicio de salud a distancia prestado por personal de la salud, a trav\u00e9s de las Tecnolog\u00edas de la Informaci\u00f3n y de la Comunicaci\u00f3n (TIC), para lograr que estos servicios, sean accesibles y oportunos a la poblaci\u00f3n. Este servicio se efect\u00faa considerando los siguientes ejes de desarrollo de la Telesalud: la prestaci\u00f3n de los servicios de salud, la gesti\u00f3n de los servicios de salud; la informaci\u00f3n, educaci\u00f3n y comunicaci\u00f3n con pertinencia cultural y ling\u00fc\u00edstica; y el fortalecimiento de capacidades al personal de la salud, entre otros. Telemedicina: Provisi\u00f3n de servicios de salud a distancia en los componentes de promoci\u00f3n, prevenci\u00f3n, diagn\u00f3stico, tratamiento, recuperaci\u00f3n, rehabilitaci\u00f3n y cuidados paliativos, prestados por personal de la salud que utiliza las TIC, con el prop\u00f3sito de facilitar el acceso a los servicios de salud a la poblaci\u00f3n. Teleconsulta: Es la consulta a distancia, que realiza un profesional de la salud para la atenci\u00f3n de una persona usuaria, pudiendo \u00e9sta estar o no presente; con fines de promoci\u00f3n, prevenci\u00f3n, diagn\u00f3stico, tratamiento, recuperaci\u00f3n, rehabilitaci\u00f3n y cuidados paliativos seg\u00fan sea el caso, cumpliendo con las restricciones reguladas a la prescripci\u00f3n de medicamentos y dem\u00e1s disposiciones que determine el Ministerio de Salud. Teleinterconsulta: Es la consulta a distancia mediante el uso de las TIC, que realiza un personal de salud a un profesional de la salud para la atenci\u00f3n de una persona usuaria, pudiendo \u00e9sta estar o no presente; con fines de promoci\u00f3n, prevenci\u00f3n, diagn\u00f3stico, tratamiento, recuperaci\u00f3n, rehabilitaci\u00f3n y cuidados paliativos seg\u00fan sea el caso, cumpliendo con las restricciones reguladas a la prescripci\u00f3n de medicamentos y dem\u00e1s disposiciones que determine el Ministerio de Salud… Teleorientaci\u00f3n: Es el conjunto de acciones que desarrolla un profesional de la salud mediante el uso de las TIC, para proporcionar a la persona usuaria de salud, consejer\u00eda y asesor\u00eda con fines de promoci\u00f3n de la salud, prevenci\u00f3n, recuperaci\u00f3n o rehabilitaci\u00f3n de las enfermedades. Telemonitoreo: Es la monitorizaci\u00f3n o seguimiento a distancia de la persona usuaria, en las Instituciones Prestadoras de Servicios de Salud, en las que se transmite la informaci\u00f3n cl\u00ednica de la persona usuaria, y si el caso lo amerita seg\u00fan criterio m\u00e9dico los par\u00e1metros biom\u00e9dicos y\/o ex\u00e1menes auxiliares, como medio de control de su situaci\u00f3n de salud. Se puede o no incluir la prescripci\u00f3n de medicamentos de acuerdo al criterio m\u00e9dico y seg\u00fan las competencias de otros profesionales de la salud. Interoperabilidad: Es la capacidad de los sistemas de diversas organizaciones para interactuar con objetivos consensuados y comunes con la finalidad de obtener beneficios mutuos. La interacci\u00f3n implica que los establecimientos de salud compartan informaci\u00f3n y conocimiento mediante el intercambio de datos entre sus respectivos sistemas de tecnolog\u00eda de informaci\u00f3n y comunicaciones para, finalmente, optimizar el uso de los recursos en los servicios de salud. Adicionalmente el decreto incluye disposiciones complementarias, entre las cuales destacan la gratuidad de acceso a estos servicios de salud, que insta a los operadores de telefon\u00eda e internet a facilitar a la poblaci\u00f3n el acceso a los canales de comunicaci\u00f3n que disponga el Ministerio de Salud, adem\u00e1s, se promueve el uso del canal digital del gobierno orientado a la Telesalud: www.gob.pe\/telesalud.
