The Argentine Senate passed a bill that will allow the regulation of the provision of telemedicine services throughout the country.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

The regulation of the provision of health services through the use of technology was approved unanimously in the Argentine Senate. Now the initiative will pass through the Chamber of Deputies. The draft regulation unified the proposals of four senators, on the principles and scope of telehealth in the country.<\/p>

The objective of this initiative is to \u201cregulate the principles and scopes of telehealth as a modality for the provision of health services and training of the human resource, with the incorporation of the use of Information and Communication Technologies (ICT) and devices, to improve the accessibility and health conditions of the population\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

Senator Julio Cobos, author of one of the initiatives, explained how the initiative process went since the start of the social distancing measures in March: \u201cWhen social and preventive isolation began by the month of March because of the pandemic we are still suffering, various initiatives were generated that sought to provide solutions and framework to the new paradigms. This happened with the education system, which is practically working electronically, and with many labor issues, with laws such as telework; and of course, the health issue was not exempt, and that's why today we are dealing with Telehealth's agreed project.\u201d<\/p>

The project presented seeks to define the characteristics and conditions under which telemedicine and telehealth must be implemented, and also intends to provide greater access to the health system for the population, to encourage technological development and connectivity.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

Recently, both in the Senate and in the Chamber of Deputies, initiatives related to Telehealth have been proposed, such as the electronic prescription that has already been approved.<\/a>The legislator stressed the importance of such laws and initiatives during the pandemic, and presented the definition of telehealth and telemedicine: \"Telesalud is a broad concept and contains telemedicine, which is the exchange of medical information through some means of electronic communication, between two actors who are not located in the same space; while Telehealth is the health system as such, making use of ICTs, with special emphasis on preventive character. It includes a full range of activities that help the patient and the general population to be healthy: prevention, promotion, diagnosis, and treatment,\" he explained.<\/p>

Senators recalled that technology applied in health through telemedicine or telehealth does not replace traditional medicine or health services in which patient contact is essential, however, they stressed that, in the current context of the pandemic, health care needed to be rethinked, so they see technology functioning as a complementary tool in the provision of health services.<\/p>

Like the digital prescription law, the National Executive Power will be tasked with granting accreditations and keeping track and evaluation of processionals involved in the exercise of telehealth and telemedicine. In this way the teleconsultation mode will have the same validity as the traditional modality. El Senado de la Naci\u00f3n en Argentina aprob\u00f3 un proyecto de ley que permitir\u00e1 la regulaci\u00f3n de la prestaci\u00f3n de servicios de telemedicina en todo el pa\u00eds. Por unanimidad en la C\u00e1mara de Senadores de Argentina, se aprob\u00f3 la regulaci\u00f3n de la prestaci\u00f3n de servicios de salud a trav\u00e9s del uso de tecnolog\u00eda. Ahora la iniciativa pasar\u00e1 por la C\u00e1mara de Diputados. El proyecto de regulaci\u00f3n unific\u00f3 las propuestas de cuatro senadores, sobre los principios y el alcance de la telesalud en el pa\u00eds. El objetivo de esta iniciativa es \u201cregular los principios y alcances de la telesalud como modalidad de prestaci\u00f3n de servicios de salud y de capacitaci\u00f3n del recurso humano, con la incorporaci\u00f3n del uso de las Tecnolog\u00edas de la Informaci\u00f3n y la Comunicaci\u00f3n (TIC) y dispositivos, para mejorar la accesibilidad y las condiciones sanitarias de la poblaci\u00f3n\u201d. El senador Julio Cobos, autor de una de las iniciativas explic\u00f3 c\u00f3mo fue el proceso de la iniciativa desde el comienzo de las medidas de distanciamiento en marzo: “cuando por el mes de marzo comenz\u00f3 el aislamiento social y preventivo por causa de la pandemia que a\u00fan estamos padeciendo, se generaron distintas iniciativas que buscaban brindar soluciones y marco a los nuevos paradigmas. Esto sucedi\u00f3 con el sistema educativo, que pr\u00e1cticamente est\u00e1 funcionando por medios electr\u00f3nicos, y con muchos temas laborales, con leyes como la del teletrabajo; y por supuesto no estaba exento el tema de salud, y por eso hoy estamos tratando el proyecto acordado de Telesalud”. El proyecto presentado, busca definir las caracter\u00edsticas y las condiciones en las que la telemedicina y telesalud deben ser implementadas, adem\u00e1s tiene la intenci\u00f3n de brindar mayor acceso a la poblaci\u00f3n al sistema de salud, incentivar el desarrollo tecnol\u00f3gico y la conectividad. Recientemente tanto en el senado, como en la c\u00e1mara de diputados, se han planteado iniciativas relacionadas a la Telesalud, como la receta electr\u00f3nica que ya fue aprobada.  El legislador, resalt\u00f3 la importancia de este tipo de leyes e iniciativas durante la pandemia, adem\u00e1s present\u00f3 la definici\u00f3n de telesalud y telemedicina: \u201cTelesalud es un concepto amplio y contiene a la telemedicina, que es el intercambio de informaci\u00f3n m\u00e9dica a trav\u00e9s de alg\u00fan medio de comunicaci\u00f3n electr\u00f3nico, entre dos actores que no est\u00e1n ubicados en el mismo espacio; mientras que la Telesalud es el sistema de salud como tal, haciendo uso de las TIC, con especial \u00e9nfasis en el car\u00e1cter preventivo. Incluye una gama completa de actividades que ayudan al paciente y a la poblaci\u00f3n en general a estar sano: prevenci\u00f3n, promoci\u00f3n, diagn\u00f3stico, y tratamiento\u201d, explic\u00f3. Los senadores recordaron que la tecnolog\u00eda aplicada en salud a trav\u00e9s de telemedicina o telesalud, no remplaza la medicina ni los servicios de salud tradicionales en los que el contacto con el paciente es esencial, sin embargo, resaltaron que, en el contexto actual de la pandemia, era necesario replantear la atenci\u00f3n en salud, por lo que consideran que la tecnolog\u00eda funcionara como una herramienta complementaria en la prestaci\u00f3n de servicios de salud. De igual manera que la ley de las recetas digitales, el Poder Ejecutivo tendr\u00e1 la tarea de otorgar las acreditaciones y llevar un registro y evaluaci\u00f3n de los procesionales que participen en el ejercicio de telesalud y telemedicina. De esta forma la modalidad de teleconsulta contar\u00e1 con la misma validez que la modalidad tradicional.  A su vez, los pacientes deber\u00e1n ser informados sobre esta modalidad y dar su consentimiento.
